Crisis of Leadership and Fundamental Right at Present time

This article sheds light on failure of government to play a constructive role in creating an atmosphere conductive for the rise of inclusive democracy constructed in 2072 B.S. inside the Constituent Assembly.

What leadership refers at present, most of the people get at surface regulation of politician? A leadership carries the meaning of responsibility, providing the fundamental rights through states system socio-cultural management, mapping all population and geography at same category with specific eyes to geography because its distinct qualities.

The leadership with different strata balance the socio-political administrative with stopping organized corruption and crime. Business leaders, now, should active to associate political leader having established constitution of Nepal to moderator the development and prosperity. Leaders in context holding power from different cluster are not being to catalyze the development function because political instability, trade deficit, import, lacking raw materials and productivity in Nepal. In some extent, Nepal is at transition at present too.

At present time all rules and regulations according to constitution in this socialism oriented, federal democratic republican state as state in article (4) should be managed. While managing this pandemic disease named Corona (Covid19) can be resolved as every citizen engages their function, concurrent as mentioned in schedule 9 of the constitution. For this purpose, every time all responsible authorities, citizen and organization pay constructive attention on their artistic function maintaining some useful information. The degrading role of media at present time in Nepal caused corruption and broker of political party indicates failure of constitution from action of executive. In part 3of constitution, transparently, there is mentioned to live with dignity in article (16). Similarly, in article (17), there is right to freedom .in clause (2) of article (17) with some restrictive provisions.  In same article, in sub clause (a), clause, (2), (3) restricts to express and to form union and associations.

As mentioned in article (18) refers right to equality. Clause (2) of the same article remains no discrimination shall be made in the application  of general laws of the grounds of origin, religion race, as caste tribe, sex, physical condition, condition of health, marital status, …or similar other grounds. But because of politicization this pandemic disease that appeared from Wuhan of China in December has been done in this Indian sub continent. Including Nepal, it has not cared its covenant relating to caste, religion and its constitution because of unnecessary information of media. Whether social media or coverage print media has analyzing this disease through religion perspective, they are not presenting the common problem of this global village.  Beaurocrat of Nepal especially police force by seeing their action over Muslim religion looks there is no right to freedom of religion as stated in article (26) in constitution of Nepal. The police who are working on the field themselves treat as terrorist. Literally, terrorism is the use violent action in order to achieve political aims or force government to act. Despite of doing nothing in this Nepalese society the event of Janakpur case of human relating to women for viral transmission, they were abjected. What was the propriety of Woman commission? Who could speak against that event? Concerning to, this Right of victim of crime in article (21) paves a position. Who was there to posses that position? Similarly, in Udaypur district, Muslim was arrested in the name of Pakistani Muslim. How does the Pakistani come in Nepal without Visa? They were Indian. They were generalized on the behalf of corona transmitter. Finally, they were found Corona negative in investigation in medical department of Biratnagar. Why the Nepalese politician and police force are are guided by CAA enhanced by Indian parliament against Muslim? There are always options to cure one thing besides another. If you can imagine or you deserve knowledge, you do not harm another. Talking on the fundamental Rights provided by Constitution of Nepal clearly looks even so called democratic state USA has also back in front of Nepal. While in application these all written rights are just limited for certain group or feudalistic people of Nepal. Contrasting the political practice has been got after around two centuries in the hand of Nepalese people, among of them some reactionary group are working as negative catalyst. In this period the educated people are not also getting the ways o practicing politics and evolving the corruption in the name of federal government.  As the wish of federal power, the ministers are taking a certain chance being a multiparty system to trap some companies and businessman as source of earning. The federal government started its enhancement through opening different cases of corrupt files. In same time, many calamities relating to human being like SARS, FLU in one side followed to this government. Different sects of Hindu religion started for Hindu state in same time the errors done by citizenship distribution committee in 2064/065 holders in the name of separate Madhesh raised their voice. In the puzzle of these political transitions this government could not get good leadership. In meantime this pandemic disease attack all European countries even it did not leave Asian and American countries too. This time is not transformation of leadership.

The restrictive rules as communist did not allow the constitution of Nepal, socialism oriented constitution whereas Nepali Communist have to promote Nepali economical and fundamental culture. Being such promised what were the other outlines of history being tested, retested in Nepali cabinet, on behalf of nationality K.P. Sharma Oli became failure formed a government in 2073 because its dysfunction and irregular monitoring however, if leadership dynamic is any mark of the central political conflict in authoritarian regime. It highlights the problem of the state. I examined some politicians of opposition group is parliamentary system of Nepal cannot follow a natural death but fragmented death with traditional concept with alternative approach in Nepali governing system as K. Sitaula and S. Koirala represent but the ongoing cabinet cannot transfer the differently abled leadership to regulate in this context having self-leadership.
